Arthenfold.org Terms of Service

1. Who We Are and What These Terms Cover

Arthenfold LLC operates Arthenfold.org ("Arthenfold," "we," "us"). Arthenfold.org helps people discover freely available creative projects, follow their creators, and participate in creator communities. These terms govern the website and its account and community services. Creators also agree to the Creator Addendum. Each project's stated license separately governs use of that project's files and other creative work.

We present these terms for acceptance when you create an account and the Creator Addendum when you apply to become a creator. Existing users are asked to accept before continuing activities that require agreement; account security, cancellation, support, and public browsing remain available. Public notices explain the conditions for accessing the site without an account. Nothing here replaces rights that applicable law does not allow either party to waive. 2. Soft Launch and Service Availability

During the initial soft launch, public browsing, available project downloads, free accounts, follows, reviewed creator publishing, and available community features may be used. Real payments, new saved-payment-method setup, paid subscriptions, and creator payouts are unavailable. Test or sandbox transactions are simulations and do not charge money or purchase real membership access.

Approved creators may publish during this period without completing payout setup. We may grant clearly identified, expiring complimentary community access; it is not a paid subscription and does not create a debt or future payment obligation.

Payment features will open only after a separate readiness review and publication of the applicable payment terms. We will not automatically enroll existing accounts in a paid service. Feature descriptions or roadmaps are not promises of a release date, uninterrupted service, or a particular future feature.

3. Visitors, Accounts, and Community Memberships

These descriptions explain capabilities, not a ranking of users or separate legal identities:

A creator may also be a supporter. A membership is a separate, creator-specific entitlement with its own conditions and duration. Neither creator status, a saved payment method, a free follow, nor a free creator subscription grants paid access to any community.

If a saved payment method expires, is removed, or is no longer verified, payment-dependent account capabilities may become unavailable. That does not automatically cancel an existing subscription or erase an already paid access period; the applicable subscription and payment rules govern those events.

4. Eligibility and Account Security

Registered accounts are for people aged 13 or older, or the higher minimum age required where they live. If you are under the legal age of majority, you must have your parent or guardian's permission to create an account and use its features; ask them to review these terms with you. Do not register if you cannot meet these requirements. Public browsing and free downloads do not require an account, but visitors should follow content notices and applicable restrictions.

For this non-adult soft launch, we ask you to confirm eligibility without collecting a date of birth, government ID, selfie, or biometric age estimate at registration. This is an eligibility declaration, not verified proof of age or parental consent. If we learn that an account belongs to a child under 13, or someone otherwise ineligible, we will restrict the account and address deletion or other required action through support. Do not submit identity documents or a child's personal details by ordinary email.

Teen creators may share their work through a creator profile operated by an authorized adult parent or guardian. The responsible adult must use their own account, accept the Creator Addendum, and take responsibility for the profile and permissions. Do not share login credentials. Future payment features may have additional legal and provider eligibility requirements.

Provide accurate account information, use an email address you control, and keep login and recovery credentials private. A public display name or creator alias is permitted; do not impersonate someone else or misrepresent affiliation. Private identity information supplied for verification or payment must be accurate.

Creator management and administrative access require verified email and multi-factor authentication. Use individual staff access where available rather than sharing an owner's password. Tell us promptly about suspected account compromise. We may require reasonable verification before restoring access or acting on a sensitive request, without asking you to send passwords, complete card details, or authenticator secrets by email.

5. Public Projects Stay Free While Hosted

"Free for everyone, forever" means for the duration that the creator makes the project available on Arthenfold.org, its published project content is available without a purchase, paid membership, donation, saved payment method, or mandatory account. Downloads may still be temporarily unavailable for maintenance, security review, a rights complaint, or another reason permitted by these terms.

This is not a promise that a creator must host a project permanently or that Arthenfold can operate forever. Creators may withdraw projects. Removal does not retroactively revoke rights already granted under an applicable project license; those rights remain governed by that license and law.

The normal offering must be the full project or full currently released version represented by the listing. A genuinely unfinished project may be shared as a work in progress when its actual scope and limitations are clearly described. Creators must not disguise a demo, trial, sample, crippled edition, or teaser as the full offering while reserving the substantive project behind a subscription or another payment gate.

Exceptions require Arthenfold's specific written approval and clear disclosure on the listing. For example, we may agree to host a clearly labeled game demo while the full game is sold on Steam. Approval applies only to the named project and stated scope; it is not blanket permission for other projects or misleading advertising.

Free access is different from open-source licensing. A project may retain copyright or other restrictions. A free download does not authorize redistribution, modification, commercial use, or use of third-party materials unless the relevant rights holder's license permits it.

6. Community Participation and Support

Free follows and free creator subscriptions help organize projects and creators in your account. They do not create a financial commitment or enroll you in marketing or creator-update emails. Any future update-email service must provide a separate opt-in and a way to unsubscribe.

Creators may offer community participation, discussion, announcements, or other accurately described benefits separately from their public projects. They may not use those benefits to evade the free-project policy. Access may depend on membership, complimentary access, moderation status, or other clearly stated conditions.

No contribution is currently available during the soft launch. When payments become available, a supporter must separately authorize each purchase or recurring arrangement. A saved method is never blanket permission to charge. We will show the applicable creator, amount, recurring interval, taxes, benefits, and cancellation terms before confirmation. The published payment terms and Refunds and Cancellations policy will govern those transactions. Support is not represented as a tax-deductible charitable donation.

7. Your Content and Permissions

You retain the rights you hold in content you submit. You must own the necessary rights or have permission to submit and share it. Do not grant rights on behalf of another rights holder unless authorized. Creator uploads are further governed by the Creator Addendum.

By submitting content, you grant Arthenfold a non-exclusive, worldwide, royalty-free license to store, reproduce, transmit, display, and make technical adaptations of it only as reasonably necessary to operate the service you requested. Examples include resizing images, removing metadata, creating previews, delivering public files, displaying authorized community content, accessibility formatting, security review, and backups. Service providers may exercise these permissions only as needed to provide those services on our behalf.

Private content is displayed only to its authorized audience and authorized operational staff. This license does not authorize selling your content, licensing it to unrelated third parties, or using it to train AI models. Separate promotional uses beyond ordinary site listings require your permission.

When content is removed, we stop ordinary public delivery within a reasonable operational period. Copies may remain temporarily in protected backups or where required for security, dispute resolution, or law, subject to our Privacy Notice. We cannot recall copies legitimately downloaded by others. Users' rights in downloaded material depend on its license.

8. Conduct and the Non-Adult Launch

Do not use the service to:

• Upload unlawful material, infringe others' rights, impersonate others, commit fraud, or make materially deceptive project or support claims.
• Distribute malware, steal credentials, interfere with the service, evade authorization or review controls, or overload the service abusively.
• Threaten people, engage in targeted harassment, disclose private personal information without authority, or publish nonconsensual intimate imagery or child sexual abuse material.
• Publish explicit sexual/adult content, or use profiles, previews, comments, community posts, files, or links to route around the current adult-content restriction.

Adult-content creator applications are not accepted during this launch. Future adult-content support, if introduced, will require a separately announced policy and appropriate safeguards; existing approval does not grant permission. Ordinary political expression, criticism, nonsexual nudity, educational material, or mature themes are not automatically pornography, but must comply with applicable content classifications and law. Ask for review if classification is unclear.

Arthenfold aims to support broad creative expression. Disagreement with an idea is not by itself a violation. We may nevertheless apply specific legal, security, rights, or service-provider requirements and explain the applicable reason where reasonably possible.

9. Reports, Moderation, and Appeals

Use available reporting controls or contact support@arthenfold.com with a link, a description of the issue, and enough information to investigate. Do not send unlawful files or unnecessary sensitive information by email. Copyright complainants should identify the protected work, the specific material and its location, and their contact information; we may request the statements or other information needed for the applicable legal process.

We may restrict content, accounts, features, or community access to investigate a report, protect users, comply with law, or enforce these terms. Where appropriate, we will identify the relevant rule and provide an opportunity to correct a problem. Urgent action may occur without advance notice. We may withhold details when required by law or necessary to avoid compromising an investigation or another person's privacy.

You may request review by contacting support with the decision and your explanation. Review does not guarantee reinstatement. Community moderation, project removal, subscription cancellation, refunds, and payout holds are distinct actions; applicable billing consequences must be addressed separately rather than assumed.

10. Privacy, Third Parties, and Security

Our Privacy Notice explains account data, essential cookies, service providers, uploaded material, retention, and privacy requests. Creator views do not disclose follower, subscriber, or donor account email addresses. Payment services, when enabled, will handle card and payout details under their own applicable terms and privacy information.

External links and embeds may lead to services we do not control. Their terms, privacy practices, and availability may differ. An external link, project approval, or malware scan is not a guarantee of safety, ownership, accuracy, compatibility, or endorsement. Keep your own backups of important work and take reasonable precautions when running downloaded software.

11. Leaving, Suspension, and Service Changes

You may stop using the site or request account deletion through support. Creators may unpublish their projects, subject to handling existing commitments and legally required records. Deleting an account or removing a card must not be relied upon as a substitute for canceling a recurring payment; when payments are available, use the cancellation controls or ask support to confirm cancellation.

We may suspend or terminate access for material or repeated violations, fraud, security risks, legal requirements, or discontinuation of the service. We will give reasonable notice where practicable. Suspension does not authorize us to keep money that must be refunded or disregard mandatory customer rights. Retention and deletion follow the Privacy Notice and applicable law.

12. Disclaimers and Responsibility

To the extent permitted by law, the free service and third-party projects are provided as available, without a guarantee of uninterrupted operation, fitness for a particular purpose, or the accuracy of creator claims. This does not exclude express commitments made for a paid service or warranties and remedies that cannot lawfully be excluded.

To the extent permitted by law, neither party is responsible to the other for indirect or consequential losses that were not reasonably foreseeable. Nothing in these terms excludes liability that cannot legally be excluded, including liability for fraud, willful misconduct, or other protected claims. These terms do not require mandatory arbitration or a waiver of class-action rights.

13. Governing Law and Updates

Texas law governs these terms to the extent consistent with applicable mandatory consumer protections. Nothing here deprives a consumer of rights or access to courts protected by the law that applies to them. Please contact support first so we can try to resolve a concern, without delaying any legal deadline or urgent remedy.

We will identify the current version and effective date. For material changes, we will provide reasonable advance notice and request renewed agreement where required. Changes will not silently authorize new charges or retroactively remove accrued rights. If you do not accept a change, you may stop using the affected service and request closure, subject to existing rights and obligations.
